  • Received RFE on B2 extension after visitor left USA

    Hi All,

My mother-in-law visited us in 2013. She entered USA on March-20-2013 and got her i94 for 180 days. Initially we booked her tickets for Sep-16-2013. Later we filed for her extension on Sep-9-2013 and changed her tickets to Oct-25-2013.

She left USA on Oct-25-2013 and by the time we don't have any updates on her B2 extension. On Dec-10-2013 we received an RFE asking to submit some additional details.

    Questions:

    1. Is there a way to inform USCIS about her leaving USA?
    2. Do we still need to submit the documents?
    3. As she left USA before any decision, will it create any issue in the future?
    4. Any advice to avoid any issues in future is appreciated.

extension processing takes several months so one should apply for it very early during one's stay.

Due to automated I-94 , USCIS gets to know of the passenger's arrival departure through the airlines.
In her case though , since the extension was not granted , her departure after her original I-94 date recorded an overstay
in the USCIS system. This will have an implication when she enters next time. The burden will be on her to prove that
she had a pending extension application and she departed during her extension processing. She must save her extension
application papers and receipt and her departure boarding passes to show when she visits US the next time.

IN the meantime one of you can respond to the RFE query by sending them proof of her departure .
