  • Mother in law visitor visa

    My mother in law is a widow and I would like to invite her to US. I am skeptical about her visa process and need some advice on following questions

    a) My mother in law is an LIC agent - should we mention her occupation as BUSINESS or OTHERS in DS160.

    b) Would it be favourable if my Brother in Law in INDIA who has good income SPONSOR my mother in law instead of me- showing up tie to India?
    Can my Brother in Law who is in INDIA (never been to US) sponsor his mother?
    If yes does he need to fill up Affidavit of Support.


    c) For Affidavit of support - do we need to put GROSS Income or Net Income?

    Occupation as "other"
    it is better if your BIL shows her funding. In the form DS 160 the answer to the ques. " who is paying for the trip"
    she should write "son". she will need to take his income proof to the interview.
    Affidavit of support is required only if someone in US is funding the trip.

    All that aside, there is a trend against granting visit visas to widows. If her son's
    family applies with her showing a trip together, it will increase the chances to some extent.

      Thanks for quick reply. We are thinking of applying B2 visa for my brother-in-law's 10-yr old son along with my mother-in-law. But my brother-in-law/his son all have Australia PR visa stamped on their Passport - though they continues to stay/work in India only. I am worried that during interview when they might find out Australia PR visa in passport of family which would impact my mother-in-law's case. What would you suggest?

        It all depends on how the officer takes it. Though it may not be a big issue because he can say he did not use that visa and is still living in india.

          Thanks a ton for quick response. Is 1 Lakh rupees per month income of my brother-in-law sufficient to sponsor both his mother and son?
          My brother-in-law's son (10yrs old) is studying in school. Does we need any specific documents for his visa processing?

            Yes, it should be enough. One can apply for the son's visa by drop box ( <14 yrs)but they can still call him for an interview later. So the best thing
            would be for MIL and kid to go together for the interview and by law at least one of the parents will need to accompany the kid to the interview with the other parent's
            no objection letter.

              I was going throught my mother in laws documents and found there her income is about Rupees 6 lacs per annum plus other properties. Is it advisable for her to self sponsor?

                  Thanks for your advice. We have scheduled appointment for Feb first week. Will let you know what happens. My Brother in law is sponsoring - to show strong ties to India for my mother in law.

                  Do I need to send any documents for my mother in law ? I am NOT sponsoring.
