  • Non-immigrant visa for spouse of a US Citizen?

    My wife and 2 kids are US citizens but i am not. I have not ever applied for immigration as i really do not intend to migrate to usa. My wife and kids stay with me. My kids attend school here in my home town and my wife is a homemaker. i just want to visit with my family to usa for 2-3 weeks max(i can get only this much leave).

    1: I have 2 fully paid apartments in my name and 1 more under a payment plan for 2 more years. All of them yield good rental income. I have rental contracts with my tenants.
    2: I personally live in a rented apartment good enough for my kids and mother.
    3: I have a job here as sales person and i get a good salary with commission. Also my employer is happy with my work as he intends to increase my salary and job responsibilities.(should i get this in writing from employer?)
    4: I have a single old aged parent to look after as she lives with me. (But how do i prove it?).
    5: My bank account doesnt have huge savings balance as i pay for property installment also but it is good enough to cover my travel expenses.

    Please tell me if my social and family ties with my home country are good enough. Can my wife's and kid's american citizenship be a negative thing for my visa application?
    Is my economic tie good enough? How do i prove that i support my mother here and that she lives with me and fully dependent on me?

    one more thing i would like to mention is that my educational background is in IT field but i work in totally different field now ( sales/purcahse in a trading company not related to IT at all). I decided to take this job as i had a some part time experience in it while studying and i was offered salary as per my expectations. And now i feel my education in IT was a mistake and waste of time. But its good to have a degree though.

    Also, i was rejected visa before. When i mentioned my family's US citizenship thing, i was told my social interest seems more in the US ( this was seven years ago and i never applied after that).

    What more do you think could be required?

    I will not file an immigration as that would require me to visit USA at least every 6 months and that is something i can not do because of my work load.

    Having spouse and kids as US citizens is a big negative for a visitor visa. There is an automatic presumption by the officers that you will immigrate even if you do not actually have that intent. It overshadows all the ties you mentioned; property , aged parent, even if you get a chance to
    explain them to the officer.

    I have read some posts where spouses of US citizens settled outside US have succeeded in getting a visit visa after repeated attempts but such cases may be few and far between. and you just have to apply repeatedly to see if you will get lucky and there is still no guarantee.

    You can take another shot at it.If the officer decides to consider your case,your income will be very important rather than any bank balance.

    If you get denied again,there is another route you can take that will solve this problem for ever. Provided you are ok changing your nationality.
    Get a green card thru your wife and then apply for fast naturalization if your wife co-operates.the whole process can be done in about 12-18 months. Once you have a US passport, you can visit US anytime and only when you want to.

      Thank u for replying sir,

      I m not sure how fast will be fast naturalization. Even a few months staying and waiting in the US for passport is not possible.
      And i cant hide my family's nationality i think because my passport copies were also submitted to the consulate when i got US passports for my kids.

      Should i just try with whatever i have or do i need any other document.?

        Hiding facts is a very bad idea anyway.

        and documents are not very important for a visitor visa. you will just have to convince them at the interview that you don't want to immigrate
        carry proof of yur employment and income.

          I hope they put an effort to look at my documents before declining visa on the basis of family citizenship
          I m carrying these

          Mother dependency visa of UAE because thats where we are based. She is on my visa here and only i can renew it which has to be done every year.
          Employment Salary certificate and Leave approval dates.
          Property Documents including property with Due amounts i have to pay in next 2 years.
          Bank Statement.
          My children school certificate
          My family's travel ticket with return dates.
          My apartment's rental contract.
          I dont think i should carry any thing else ( ex. Car docs, utiliti bills in my name, credit card statement)

                i just got back from my visa interview. They didnt look at my documents. not even a single paper. She (VO) talked to me for 2 minutes max and gave me a pink colored paper and said i can collect my passport from the courier company i selected while filling the application form online.
                The pink paper reads: Dear Applicant. Your visa application has been approved. your visa will be available for pick from Empost POS that you selected. You document will ready for pickup 3-5 days after your documents are released from the consulate."
                These are almost the things written on it because i left my pink paper at my office today so i cant write exact words from the sheet.

                I thought pink is rejection but it says that its approved.

                  I want to apply for a B2 TOURIST VISA, however I am Chinese and my husband is a US citizen. We have been married for 4 months now, no kids. I am planning to visit his US family for a week in December this year. I do not wanna immigrate anytime soon. So I wondered what kinds question the VO asked you? And how am I gonna convince them I really do not wanna immigrate? I am a housewife now. I feel this is the biggest issue for me. By the way, did the VO check the paperwork you brought with? I have heard that the VO does not even check the paperwork, all they do is to ask question.

                    Snowcrash - you still around? interested to know which option did you apply as:
                    1. letting them know that your spouse is US citizen
                    2. not letting them know that she is a US citizen and providing proof that you have no desire to stay in US?

                    I too have similar situation: I have dual citizenship: US and Iranian. Currently live in Iran and would like to visit US with my Iranian wife for few weeks. I know I have to apply for her as a non-immigrant visa / tourist visa.

                    question: should she apply as a regular tourist visa without mentioning any relationship to me. For example, visiting her friends in US with proof that she is coming back to Iran. OR, would it be better to explain that we are married and we just want to visit US for few weeks.

                    would appreciate any thoughts on this matter.

                      Visa denied to my Spouse , is it because im a US Citizen?

                      Im a US citizen..( with dual citizenship ) my spouse is Nigerian. He's been trying to apply for a Non immigrant B1 visa and has been denied 3 times..( once while we were in Nigeria and even now that im in the US to have the baby with my hospice records, invite etc) they still denied without any encouraging hint as to why. Could they be denying him the Visa because im a Citizen? Thats what his family members are telling him and some front door staff at the embassy.. Is there any validity to that?
