PIO for newborn Child - Parents on B2 visa or Visa Approval Pending

My situation :
1. My L1A visa extension got rejected. I initially came on L1B visa , 3 years
back
2. My company applied for B2 visa , so that baby can be born, as due was
close. It is pending approval by USCIS for past 3 months
3. I have the US Birth certificate and Passport for the baby
4. I need to travel to India for good by 15th February 2014.

Question
Can I apply for PIO as I don't have an approved B2 visa. Will I get PIO ? as i read somewhere Parents valid Visa documents need to be submitted

Its says Valid Visa for Parents needed to apply passport. Parents might or might not get an approval on the pending visa?
