  • Marriage Green card application and H1B expiration

    Hi
I am currently working in the USA with an H1B visa. Although the visa expiration date is March 2016, my current employer has extended my employment only till July 31st of 2014.
I recently got married to a US citizen and am going to apply for a family-based green card soon. But what happens if my green card is not done before my H1B expires? The green card application has two processess, the initial petition (I-130 in my case) and then adjustment of status (I-485). Would I still be safe if my I-485 is in before the H1B expires?
Please help with some advice. I am really confused about this.

    Thanks

go for a concurrent filing I-130 + I-485( adjustment of status from H1b to GC) before July 31, '14.
As long as your I-485 is pending ,even if you go out of H-1b status due to
being terminated , you will be absolutely fine.

Thank you!! That's a relief to know. Yes, I am preparing documents for a concurrent filing.
