    Dear Forumers,

    My father was a Seaman and entered the US while their ship was docked on one of it's ports so technically, he entered legally but have overstayed. Correct me if I am wrong but what I think his status now is "out of status".

    He's been staying in the US for more than 20 years supporting us financially while working odd jobs. His case is now with an immigration attorney but whenever I ask him about it, he never really clarifies it to me or to our family including my mother. He is just telling us that it is under process and just waiting for the results.

    Now, i have my own family and also working overseas with a stable job and wanted to get a B2 visa to visit him and check his real status and maybe convince him to come home and just take care of his grandchildren and enjoy life. Me and my siblings are planning on sending our mom to the US as well for a couple of months to experience where, what, how my father was living life for the past 20 years but I wanted to make sure that no 3rd party is involved (another woman, family) before my mom finds out for herself, I am the only male in the family and i think it's my duty to know. Also, I wanted to know if living out of his home country for so long made him afraid to go back as it will be difficult for him to adapt/adjust. A lot of thing comes to mind.

    Question:
    1. will it affect his situation at the moment and be deported back home immediately if I apply for a visa stating the above information to the consul officer (i do not want him to lose time, effort, money as I have mentioned above, his case is already being checked by an Immigration Attorney according to him).
    2. what will be my chances of getting a visa approval if my main reason of going to the US was to check the status of my father and convincing him to go back home.

    I suggest you don't mention him in your application since it has been over 2 decades, and since he's not the one sponsoring you. Maybe it's best if your say your going for vacation which means holiday. Just make hotel reservation coz you don't really know he's situation there so it's better you avoid any doubts of you not getting your visa by mentioning your dad and avoid causing him more damage. My opinion not legal advice. What country are you from?

      hi, thank you for your thoughts. The main reason i'm going to the US is only because of him. I wanted to convince him to come home. He is already 67 years old turning 68 this year and me and my siblings are already having our own family. He does not need to stay there to support us. I just think that if I lie to the VO, it will become more of a problem as I need to mention him anyway on the DS160 including his status and last address.

      I am from the Philippines and currently working here in the Middle East for almost 10 years.
