  • Returning after 4 mths out of US

    Hi:

My mother-in-law is currently visiting for a 2 mth period (09/05-11/05). Her I-94 has an expiration date of Mar-7-2006. She has a 10 year B2.

She would like to be in the US from 02/06-06/06. Is she in risk of a complication with the INS officer at the POE considering
    1. she has spent 2 months in the US just 3 months earlier?
    2. her present I-94 expires about 1 month after her next entry to the US.

Please share your experience. I would greatly appreciate it.

    Thanks.

Her current I-94 expiry date has relevance only for her current visit.
She will be issued a new I-94 with new dates when she enters again.
Reentering after 3 months is not advised. Inspector has the
right to stop them for making visits too quickly.
