    Hi,

    I am working in the US on an H1 B visa that expired in 2013, I-94 expired in 2013 too. I have an approved Extension of the same visa till 2016. I am now planning to visit india and get my stamping done. Can i sponsor my parents for visitor's visa now, get their visa interviews scheduled around mine so that they can travel to the US with me when i come back? Is it necessary for me to have a valid stamped visa on my passport BEFORE i submit my parent's visa application?

    Any guidance is appreciated.

    When you got your H1 extension approved, you must have received another I-94 with the extended date.

    If that is the case, you are in legal status and you are fine.

    You don't need valid visa stamp in your passport in order to sponsor your parents' visitors visa.
