  • I94 and Passport expired long ago Help please

    Hi
I don't know if my last thread got posted or not so...
I need help/advice. I moved from germany to the US in august 2002 when I was 17 yo with my mother (german) stepfather (usa) and little brother (both) on a 90 day visitors visa... and i believe my parents havent filed for anything. I went to high school (I don't know how that worked) and graduated in 2004 and have been trying to make a living ever since (under the table of course). My passport expired in 2006 and my i94 long before that, is there anything I can do to make my life easier like getting a drivers license, ssn or something without having to go back to germany? Please help me

I guess the only way for you is to find a US citizen spouse.

For all other categories, there is a long wait.
And even if you wait it out, you cannot adjust status to green card because you have no status.

THe only exception is a petition filed by a US citizen spouse.

By the way, what is the current status for your mother and your bro?

I'm not sure about my mothers status, she is pretty much the same as me except she is still married to my stepfather who did not help much in either of our cases.

My brother on the other hand is all set, he has dual citizenship, drivers license, ssn etc.

So I would have to get married to a US citizen? Or what would happen if I get a new passport from the consulate in LA and then go to tijuana, mexico for a new i94? Would I face denial for entry to the US or perhaps even deportation?

-if you leave US , you won't be allowed in for another 10 years ( 10 yr bar for overstaying your authorized stay for more than 1 year).

There could be waivers for the bar I am not aware of them, you could talk to an attorney , but they will be difficult to obtain.

Even if you got over this 10 yr bar thing somehow, they will never give you another visitor visa ( you cannot use your visa waiver anymore).
You could try for other non-immigrant visas like H-1b if you are eligible.
All in all it would be risky to leave US.

Is this brother of yours a half brother?

Ok, so getting married is the only way to go. Thank you for your help I appreciate it a lot.

And yes he is my half brother... do you think he might be of some help?

About your bro; no, I do not think he can be of any help. I just asked.

If you do not go want to go by the US citizen spouse way, talk to a good attorney, there may be a waiver
possibility somewhere . I am not an attorney so I could be missing something.

            Good luck.
