  • Getting a visitors visa

My husband is an Indian citizen. He would like to come to America for a visit. We have not registered our marriage in India or America to date. What would be the best option? He would like to join me on my trip in May if possible but would definitely like to come to visit in December. Can he apply for a visitors visa?

I'm an American citizen. I have lived in the us for forty years. My husband has lived in India his whole life. We got married 1 year ago in an indian religious ceremony. I am currently living in mumbai with my husband on a visitors visa. I would like to extend my stay beyond six months.

In the current situation,a US visitor visa will be very difficult to get.
Because there is an automatic presumption of immigrant intent being married to a USCitizen.

However, it could be possible if you established residence in India rather than just being a visitor and
he would apply showing he does not wish to immigrate to US.

In the end it all depends on what your future plans are . Living together in INdia or moving to US?
If the latter is true, you should file an I-130 ( immigrant petition for him).
