    Hi,

    I am going to apply for my Mom's visit visa to US. I am currently on I 94 which is valid till July 2016.

    I have the following questions:

    1) I have not applied for my birth certificate till now. When applying for my mom's visit visa (my father is no more, hence applying only for Mom's visa), will she need my birth certificate to show the relationship? My passport has her name would that not be sufficient? If at all she needs my birth certificate, at this point in time, it would be difficult for me to get it done as I am in the US. Is there any other alternative like an affidavit etc? If there ia an alternative, can you share with me a format of the affidavit? I would modify it as needed. I would apply in Hyderabad consulate in India, not sure if they would press for birth certificate to show the relationship? I know that some consulates in India asks and many do not even ask.

    2) As i said that I am currently on I94 as my L1B Visa expired when i came here. Would my being on I94 have any impact on the application of visit visa of my mom?

    3) I would sponsor my Mom's tickets etc. What are the things that normally the interviewer would ask my mom with respect to purpose of visit, etc. She is going to visit US to meet us.

    4) Any other stuff that i should take care.

    Birth cert. is not a mandatory requirement. But it all depends on the officer. Some may ask for it , some may not. affidavits to that effect are not required.
    In your situation, you will just have to take a chance without it.
    No it won't matter if your L1b is expired and your I-94 is valid. YOu should send a copy of approved L1 petition and a copy of your I-94 stamp and visa ( even if expired).

    In general, there is a bias against widows, and if she does not have any other children in India and she is not working, frankly, it will be
    difficult for her to get a visitor visa. To improve her chances, she should show self funding with her own money if she has good savings.
