    Hi

    I am a Green card holder and I got married in India last month. I plan to return to US later this month.
    I am in the process of filing I-130 for her. I have also scheduled a Visitor Visa appointment for her next week.

    Questions regarding Visitor Visa:

    1. Main intent is to let her travel with me later this month for a brief period - say 4-6 weeks for site-seeing and then she will return to India and wait for her Immigration Visa (IV).
    If IV takes longer, we want the flexibility to visit each other for short duration.
    I can't show her strong ties in India as she is not working here.

    Questions regarding I-130:

    1. Can I file I-130 application for her while I am still in India, or can it be done only after I return to the US?

    2. Do I need to get her passport re-issued with my name entered for spouse or would marriage certificate suffice?
    (Based on ustraveldocs.com website, marriage certificate should suffice, but double-checking)

    Suggestions?

    Visitor visa will be almost impossible to get.
    Spouse of a GC holder ; there is automatic presumption of immigrant intent which is in direct conflict with
    the requirements of a visitor visa( non-immigrant intent).

    These days F2A category I-130 , there is not much wait, so that is all the more reason for B1/B2 to be denied.

    1. It has to reach USCIS in US , it does not matter you mail it from India or from US.
    2. Certificate will suffice.
