  • Visitor's Visa

My mother's Visitor Visa got rejected (214 B) on Sep 29 2005. Both my parents are retired. My father got his visa on Sep 2003 and my mother was in Canada then, so she couldn't apply for Visa.

Q1) I have two sisters. Elder sister settled in Canada and younger sister is unmarried and currently in U.S on a short-term project (H1, 4months). Should I take the 2nd appointment for my mother after she returns back to India or is it ok to make another try?

I am planning to process Visa for my in-laws also. My mother-in-law's appointment is in Dec. My father in law is still in service and his appointment is on Jan.

Q2) My wife is employed in U.S. Should I process my in-laws papers or should I ask my wife to fill the I-134 for them?

What were the details of the interview and what was the reason for refusal?

VC asked her how long she is going to stay?
      She said 6 months.
      Then the visa officer said,
"It’s mentioned as 5 months in I-134" and then he asked
"Does your husband have a Visa?”...
My mother said "He has for 10yrs"...And told him that she was in
Canada, when my father got the visa...
Again the Officer said "you could have applied from Canada, do you know that?". My mother said "No"....

She got rejected in 214 (b)...Intending Immigrant Provision

She should not have said 6 months. It is
considered too long by some consulars and borders on an immigrant intent.
This is probably what got her the refusal in the background of her husband
already having a 10 yr visa. If she still has the canada visa , she could
plan a canada visit and apply for a US visa with a return ticket to and from canada for a very short visit to US ,say 2 months. And she should do it
after waiting a while when she can explain the change of desired stay
        from 6 to 2 months.

Maybe it would be better in canada.. she could say that due to long wait
in chennai , she could not apply in chennai.
I do not think it would matter if your dad is still in India.
