  • B1/B2 extention to a 14 year old child during the school time

    Hello,

My parents and my 14 year old sister will be coming to USA this summer, my dad will leave the country in the end of August, my mom will have to stay here for a longer period because I will be filling her papers to get a green card, so my sister of course will want to stay here with my mom. If they all come 1st of June my sister should be fine to stay here untill November the 1st , but I want to extend her B!/B2 visa for another 6 month ( till may 2015) so my question is: is it possible to extend the B1/B2 visa for a 14 year old child,? and could her extension be denied based on the fact that she is still a minor and she should be back in school instead of travelling in USA.( is it a reason to have her extension denied? )

    Thank you

you are absolutely right. It could be denied for that reason.

And in reality , Don't you want her to attend school back home?

Or are you thinking , once your mom gets a gc , she can file for her daughter under F2A?

....that is exactly what I was thinking!

Ok, if her extension gets denied and we still deside to keep her in the country and even send her here to school ( so she will be overstaying her B2) will it be an issue for her to get a green card from my mom ( once my mom gets her gc and decides to file for my sister).

I appreciate your answer ( did not even think you would answer so quick)

      Thanks again

Your petition for your mom is an IR(immediate relative) petition , so even if she goes out of status(overstays) , it won't matter.
But your sister's petition by your mom will NOT be an IR ,so there , your sis has to be in-status( no overstay) to get a green card.

what is the nationality of your parents and sis?
For all countries except mexico, the cut off date for F2A in march14 is sep13. which means about 7 months to reach priority date.
when your sister's priority date arrives , she will HAVE to be in-status to get a green card.
And Your petition for your mom alone will take 6-7 months.
So it is impossible for you to keep your sis in some status for 14 months. And it will become a mess if she overstays.

Send your sis back a couple of months after her visit.
After your mom gets her GC, she can file for your sis and she can get her immigrant visa at her leisure in her home country.
        without missing school.
