  • What's our chance for B2 Visa approval?

    Hi, I would like to thank you for creating this site, it's very helpful. I would like to ask for your advice. Here's my situation:
    I am 30 y/o, married, working in a pharmaceutical company. I previously have a 10 year multiple visa which expired last Aug 2011. I have been to the U.S three times and every entry, I was given 6 months in my I-94, so I maximized my stays up to 5 months. I got rejected for the H1b application last Feb 2012. I am now married,but no child yet, he is working as an architect and a part owner of their company. We are planning to apply for a B2 visa again so we can visit the United States to take a break ,for pleasure and vacation purposes hopefully this coming July or August while the weather is nice.Considering my travel history to the United States and the rejection of my H1b application, what is our chance in getting a B2 visa? Can you give me an idea on how much income (in $USD) is the safe or acceptable amount inorder to get approval.

    1.what was your purpose on each of 3 visits? was it business or pleasure? why did you stay 5 months each time?
    and did you stay with a relative? were you not working in India at that time?
    2.Do you have any relatives in US , on what visas?
    3. why was your H1b denied?
    4.what is your and your hubby's yrly income roughly?

      Thank you for you for your reply, here are my answers to your questions:
      1. They were all for pleasure and vacation purposes, I took time because I waited for friends and relatives to get a break from their work so they can show me around, I stayed with relatives and friends, I stayed from east to west coast. The first time I went, I just graduated from college so I took time. The second time, I waited for a friend's wedding and the last time, my aunt ask me If I could stay for awhile because her eyes just got operated, she needs someone to assist her,I was working then, and I took a leave from work.
      2. Yeah, I have relatives, they are immigrants and already hold american passports.
      3. The letter states that the job offer does not qualify as a specialty occupation.
      4. 20,000 dollars a year,and mine is 6,000 dollars annually.

        They look at your income in rupees and not USD . Anyway $20000 means about 120000 Rs which is good income for your husband to show self funding of the trip
        for both of you. Past H1b denial won't have any bearing on this visitor visa. Yes, the officer may ( or may not) ask about your long stays ( 5 m onth each time ) on every visit to US on the expired B1//B2.
        Just have an explanation ready.
        Ask for a stay in US exactly matching your leave from your employer.

                    a lot depends on the income. $26000 combined family income is considered good in India for a visitor visa . I do not know about phillipines.
                    Plus the stay of your vacation should not be too long (not 5 months , 4-6 wks only). And both of you must show proof that you are
                    taking leave for that same period from your employment. If own business then you should show arrangement to run that while you are away.
                    And your past history of long stays 5 months each time, may or may not affect depending on the officer.

                        hi peace999, i have another querry,i was looking through some of my documents and i found out that my sponsor filed h1b petitiin for me twice.first was filed in nov 2011,got denied feb 2012,then they filed again june 2012,denied on jan 2013,the first application last nov 2011,i was in the states so application for change of status was made.my worry is,will this affect our applucation for b1/b2?thank you so much in advance for your reply.

                          Usually past rejection's for a different visa category has no bearing B1/B2 visa. Given your family income and past travel to the US on B1/B2 visa there should be No reason for rejection.

                          Having said that, to get an approval you must:
                          1. Demonstrate strong ties to your country which could be in the form - good job with income, property, family, business, etc.
                          2. You must have a genuine reason to travel and your duration of stay should match that
                          3. You must prepare a strong answer for your past long stay in the US
