  • In Laws Visitor visa Rejected, Experts advise needed.

    My Friends in laws were rejected B2 visitor visa. In 1984 they came to USA on immigrant visa which was applied by their relatives(Father in law sister). They stayed for one year and returned back in 1985 and never came back to USA. They did not apply for citizenship also. Now me being the sponsor they applied for B2 visitor visa. After a couple of questions about their previous travel the visa officer said as already they had immigrant visa they cannot be issued a non immigrant visa as per rules. But their immigrant visa was in 1984 and it might have expired as they never traveled back to USA. Just to be correct in providing the information in DS-160 we had to mention about their previous travel and immigrant visa information.
    Now we are confused how to proceed. Can any one help and guide the right process?

    yes, it was so long back and their green cards must have expired.

    But the problem here is that they have shown immigrant intent once so the officer thinks
    they have the potential to immigrate again. Hence no visitor visa.

    Please be more clear;
    *how come you are sponsoring your friend's in-laws. that sounds very strange. Where is your friend and who are they visiting in US?
    *The original sponsors of immigrant visa, where are they now? Who was it exactly who filed for their immigrant visas in 80's.

      I am sorry for not being specific in first place, this issue is actually my friends issue who is concerned right now and i posted here on his behalf to get any advise which might help him.He sponsored for them and he is here inUS

      The case is his In laws(Father in Law) came here in 1984 with his sister(Father-in-Law's Sister) being sponsor who is a doctor and she is still here in US, They stayed here for an year and went back to india and never bothered to surrender the cards, So the visa officer today pointed about those cards and denied the visitor visa.

        even people who surrender their green cards formally to the embassy , find it difficult to get visitor visas. The reason is like I said, once an immigrant intent is shown, even if 20 years ago, it becomes difficult to get a visitor visa.

        what is the visa status of your friend and his wife? If wife is a US citizen , she can get her parents to US on an immigrant visa again. That is the only way.

          Thank you peace999 very much for your valuable inputs, unfortunately my friends wife is not an citizen, so we have to see other options.

            Thank you Peace999, I am the one Sunny is talking about. My visa status is H1-b and wife is on student visa. Can they surrender GC now? Would be helpful if they attend interview one more time?

              their gcs are expired and invalid anyway. they can try again for the visitor visa and try to convince the officer that they have
              strong ties in home country and no intent to immigrate. If FIL is working with strong income , it will help.
