  • Getting a Marriage License on a B2

    Not sure if this is the right place or not, but is it legal to get a US marriage license on a B2 visa? I am a US citizen and my wife is Indonesian. We are legally married in Indonesia and have the appropriate documents to support or marriage. However, according to the US Embassy in Jakarta, any marriages taking place outside of the US are not officially recognized or entered into the database. As such, my wife and I would like to get a US marriage certificate as well. We will be traveling tho the States soon and are hoping to get a marriage certificate. Would doing this:
    A. be outside the bounds of a B2 visa
    B. create further problems in the future (we plan to move back permanently in the next 10 years)

    I should also mention that getting a marriage license was just an afterthought and not the purpose of our trip.

    Hello, buleinindonesia.

    From what i know, there is NO problem in a B2 visa person getting married to a US Citizen. There are things, following the rule-book. When you enter USA, at the Port of Entry (POE), if you say the intent of entering USA is marriage, they will deport the visitor from the airport. So, at POE, please say, you are entering on holiday for travelling.

    Now, after entering if your intent changes, or you entered with that intent - No one knows. But, if you say you are entering USA for marriage, they will for sure deport that person.

    A number of marriages take place where people overstaying in USA on their tourist visas get married to a US citizen and get a Green Card (GC). So, there is nothing barring people from marrying a US citizen on a tourist visa. Many marriages are **** marriages, to obtain GC.

    When an alien marries a US citizen, the alien is given a conditional Green Card for 2 years. In this 2 year period, the USCIS / or valid authority might conduct verification to establish whether you are genuinely married and living together or not. Someone who is genuinely married should not have any worries. After 2 years, they call the couple for an interview, to remove the conditions from the Green Card and make it a permanent Green Card for the alien. At this time, they would want to see proof of marriage like:
    i) Marriage pictures, ii) Registration, iii) Joint ownership of property / car, iv) Rent Lease in joint name, v) Bank account in joint name, vi) Any children.

    For a genuine case like yours, there is nothing to worry. Many people with **** marriages also get Green Card.

    But, do seek opinion of an Immigration Attorney to understand paperwork. Do a google search and you will be able to find good attorneys. Check their ratings and reviews left by people (on Google).

      The U.S. Embassy misinformed you about marriages outside the U.S. not being recognized. Your Indonesian marriage is recognized in the U.S., as are thousands of other foreign marriages of immigrants every year. There is no "central database" of marriages in the U.S., as such government recordkeeping is a local or State functin.

        I agree with rayb. You don't need marriage certificate/license again from the US. As long as you are legally married in any country as per that country's laws and have the certificate indicating the same, you are good.
