    Hi,

    I've been a permanent resident since 1983 and since then I had only been out of country three times for no more than two week period till 2007. Then I was out side of US for a little over 3 years and 3 months and returned to the States in September 2010.

    I read somewhere on USCIS website a few years back that I would be eligible for applying citizenship after continuous presence of 30 months. Maybe I mis-read it or maybe not but now what I see is that I need to be in the country continuously without a break for 5 years which means that I have to wait till September of 2015. Is this correct information?

    What would be your advise? Thank you

    there are two different requirements; continuous residence and physical presence.

    physical presence; 30 months in the last 5 years. Meaning you will be eligible to apply in september 2015.
    you can leave US for 30 months in total during the 5 yr period sept 10 to sept 15.

    But you must leave in a manner that does not jeopardise the other requirement" continuous residence". For example , your leaving for 3 years at a stretch was in violation of
    continuous residence. Leaving for more than 6 months a year can disrupt the continuous residence requirement.

      September 2015 will be 60 months in last years since I came back in September 2010. "30 months in the last 5 years" would be put me 30 months after September 2010 which is March 2013, wouldn't it be?

        you donot follow.

        it means you can apply after 5 years ; but those 5 years you must be physically present for 30 months at least.

        it does not mean you can apply after 30 months of physical presence.
