    I have a friend who is coming to visit for a month from Europe.

    He will NOT be seeking employment during his trip.

    Given the nature of his job in Europe, he will need to spend 2-3 hours per day working online while he is here.

    He will spend the other 21-23 hours per day doing what tourists do.

    Going by the letter of the law, will he be breaking any laws?

    (I told him no, because it's the same as me checking my voicemail/email when I'm vacationing in Europe)

      If your friend is not on the active payroll of a U.S. company with an anticipated W2 at end of year, or working as a legal contractor and being paid by U.S. companies, I don't see that he can be considered violating the regulations which prohibit employment of visitor visas.

      That is how I view your question, but it's only my personal opinion.
