did they give her any denial slip like denial under sec 214b
the questions she answered wrong, were they answered correctly in the form?
what did the officer say when she answered wrongly and in then end how did he finish the interview?
What is her husband's income roughly annually?
    Is your sister working?

      Thanks for your reply
Yes they gave her a denial slip. On the slip it says that you could not demonstrate yourself.
Yes they were answered correctly in the form.
He said we have more information than you.
USA laws are very strict. We can not give you visa at this time.
Her husband income is around 5lacs
      And she is house wife.

Yes, I think it was because of her nervousness. I think she should apply again if she can risk another $ 160 x 4.
Risk because there is never a guarantee with visitor visas. But if she goes with confidence, she could get it.
When asked what has changed, she can say she got nervous and did not reply
some questions correctly last time. If she is not comfortable with English, she can opt for her local language. These days several of American consulars are bilingual.
Her husband's income is not enough for self funding or she could opt for that. But it is ok , several people get visas on hosts' funding.

Thank you so much for your help peace999.
Yes she can risk another 160x4
So should I try around Christmas or next summer. Because that's the only time kids have no school. But in winter it will be only for 15 days.
And one more thing what should she answer if they ask her again that how I came to America. I came here on b1/b2

Ok. your going on a B1/B2 could be another reason. They do their check .And they have this thing against people going on visitor visas and then changing status.
They think other family members could do the same. As she said she did not recall how you went and other wrong answers, they did not like it.

The best she can do is try again. The most important thing is she should answer honestly. If they ask about you she has to say you went as a visitor
and go on to explain why you changed status there.
When you want to apply this year or next year it is up to you. Yes, wintertime, it is only 15 days of vacation but if they get the visa, the stay given
at airport for first timers is usually 6 months .

Thank for a quick response. If she will tell that I went on a b1/b2, they won't take it wrong way.
I am assuming. Yes no matter what the outcome will be , she will be truthful. What are chances of getting the visa with young kids. Please advise

                Kumar,
it is very difficult (almost impossible) for your sister and her kids to get the visa. I am not trying to discourage you, I am talking from my own experience. My sister and her son's visa were denied the first time 10 years ago and their ages were
were 35/9, sister was a school teacher and her husband an army officer. I was a GC holder at that time and came on H-1.
Two years later i again tried for her visa, against denied.

In your case your mother is settled in USA as GC holder by your sponsorship (I assume), that is one strike against you.
Your sister denied that your mother lives in USA, it is clearly visible to the VO on their computer, it is a real big strike against her and that answer they would have noted in their system jeopardizing future attempts.
You came on B1/B2 and settled here, another negative. Your sister has 3 kids and they will very likely assume they will not return back to India. Honestly, if I weer you i would not waste money on future attempts. Don't get disappointed, life is more than visiting USA.

                Cheers

Thanks RC. Was very busy because of Mother's Day that's why couldn't respond. I understand you were in same situation.
But isn't it American law to unite the family. If my mother got a GC through my sponsorship , how that is against me. And my mother visited me in 2009 on a tourist visa and she is a widow, which is hard to get too. went back home. Than she came in 2012 on GC. But it's about my sister. I really want them to visit here. So what precautions should I take in case we try again.
                  Thanks in advance Peace999& RC
