  • B2/B2 visa overstay??

    I entered in the U.S on B/b2 visa on 8th Nov.2013. I got stamp on my passport that I am admitted till 11 may 2014. I left the U.S on 9th May 2014. I did not get any i-94 form. I checked I-94 form online which says I was admitted till 7th may. Does that mean I overstayed in the U.S although stamp on my passport says I can stay till 11th may?

    I am a researcher in prestigious university, what are my chances If I reapply for B1/B2 visa?

    I would really appreciate you help.

    are you sure it was stamped may 11 , 2014? Read it again, because counting 6 months from 8th nov , it should be 7th of May.

    if it actually was may 11, 2014 , it was done in error. So no fault of yours.

    Is your B1/B2 expired?

    Also , did you enter as a B1 or as a B2 ? And why did you stay 6 months? What happened to your work at home for those 6 m onths?

      I was admitted in the US on B2.( I got b/b2 visa which will be expired in 2023) I checked 100 times, it was stamped may 11, 2014. I was in the US for my research in G*****enterology in prestigious hospital in New York. Fortunately my research got accepted in the Conference which was held in Chicago where I had to present my research on 5th & 6th may, 2014 hence I stayed for a long time in the US. I left my job in my home country for this research opportunity.
      My question is whom should I contact to prove that my overstay was not intentional & it was due to their error. I also want to re-enter in August, 2014 for my research again for 2-3 months,If I don't then my career is at risk.

        If you noticed this discrepancy while in US, why did you not contact a CBP office ?

        now you can't do much because you have left US.

        The only way now is to prove to the officers at next entry, that you left timely.

        Save your boarding passes for that purpose. Also your home arrival stamp will work for that purpose.


        another important thing;

        regardless of the stamp issue, they will stop you, cancel your visa and send you back for sure if you will come back in august.

        For such long term research , there are other visas like J-1. You can't use a B1/B2 like this.

          Who should I contact for this issue? I really didnt know how to check I-94 online, I checked it when I came back to my home country. I admit my mistake but it's due to their error. I could not apply for J1 research because I did not get paid through research & hospital where I was doing research don't sponsor J1 research visa.
          my question is-

          1. If i want to come back in august, should I reapply for B1/B2 visa again?
          2. If I apply for J1 research visa then what are my chances?

            Your current B1/B2 may still work as it is not your fault. But entering in Aug. is not advised. And applying for another B1/b2 does not make sense
            as you already have a visa.

            If you know someone in US, have them call the CBP office about the problem. The list of "deferred inspection sites" is available on cbp.gov

            About J-1, your host should be willing to sponsor a J-1 for you.

              I don't have people who can take my responsibility & call CBP. Instead I will call CBP from my home country & email them too. I hope this will work out.

                Overstay b1/b2

                Hey guys,

                Just posting as this website helped me out when i was looking for answers to my visa issues.

                I am a medical student doing rotations in the states, I initially applied and revieved a visa that was valid for 10 years and multi entry a B1/B2. I used it to enter the states and commence my rotations, I accidently overstayed by a month as i thought that the visa was valid for 10 years and i can come and go as i pleased. Just pure ignorance on my part.

                Any way i left to visit family and when i tried to come back they cancelled my visa and told me that i had to apply for a new one. I did this and recieved one, this time it was only for 7 months (the duration of my scheduled rotations).


                I used this to reenter the states through the land border, the officer there was very nice and understanding he told me it wasn't a big deal and not to worry. I am still worried how it will look on my future visa applicaitions as an overstay is always bad but it was an honest mistake i wasn't trying to overtay.

                anyway i don't know if this helps anyone just trying to add my story.
