B1/B2 Visa. Is it required to declare F3 Petition filed on behalf of Spouse?

    My current B1/B2 visa expires soon after 10 years. My wife's mother had filed her immigration petition in more than 10 years ago which is currently at NVC.
    By going trend her petition may become current in 7-8 months and letter is received from USICS.
    I am applying for renewal of my B1/B2 visa. Shall i say yes to "Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services?"
    Technically it's filed on behalf of my wife but eventually i also get considered for immigration.

    Were you married at the time of filing of petition and was your name mentioned in the petition?
    If not, did she add your name to the petition after you got married?

      we were married at the time when petition was filed. my name was also submitted

        You should answer YES to the question as you are also a beneficiary of the petition.

        Saying NO will constitute misrepresentation and can affect your F3 immigrant visa decision in future. It is not a minor thing.

        In fact, in my opinion, you should not even go for a visitor visa, as it is likely to be denied because your F3 is so close to getting matured.
