  • Re-apply for B2 visa for family after first refusal

    Hi
I have applied for B1/B2 for self and family in the month of April/May 2012 as i was going to Lexington USA for audit and wanted to take my family with me. What i have done is that in the application form i have mentioned that my wife's sister lives in newyork and for the stay i have mentioned my Lexington hotel and mentioned in the interview that after my work we will go to my sister in law in newyork for couple of weeks.

in the interview, they have asked few questions including do you have any relative in US? i told them that yes my wife's sister lives there. after that she asked me few questions regarding where i m going and the reason for travelling. actually i did not hear properly few things and got confused in couple of things like where exactly i am going, either georgetown or lexington. anyway, for my wife and son (3 years old at that time) the officer refused by saying that she has not mentioned strong ties in UAE and there is more ties appears to be in US and refused the application.

for me she gave me yellow paper for further administrative processing. but finally i got the visa and went and came back. it is valid till 2017.

now, we want to apply again. Shall i make the application showing same audit trip and not to mention my wife's sister address or any presence in US. if they take out old application and ask where is her sister we would say that she moved to canada etc. OR my wife apply for self and my son saying that they are going to spend summer vacation with their cousins in newyork and not showing my visa altogether.

one thing to mention that after refusal of my wife and son , we also applied for canada and went there and that visa still valid till 2015.

so guide me either to show my official trip skiping wife's sister information OR showing that wife and son is going on vacation.

further it was mentioned in the refusal that if the circumstances get change in future to convince your strong ties in UAE you can re-apply at that time.

    please guide me
    regards
    Danish

if her sister still actually lives in US, your wife cannot omit that info about an immediate relative.
but the difference from last time can be that your wife does not need to put her in the contact info or the person she is visiting.

Your wife just needs to mention the purpose of trip as accompanying you on the business trip and place of stay as hotel or wherever you will be
staying. This is a natural sounding purpose( accompanying husband on his trip)Do not even visit her sister in practice this time.

Since you have already returned using the visa, that is another positive thing. She must take a copy of your visa with entry stamp page to the interview.
( or if possible your passport).

Thanks for your reply. so, you mean i will apply again with the address of staying with me in the hotel in Lexington and what about the columns for the info regarding your relative lives in usa? shall we mark NO this time, whereas i put 2 years back about her sister's details. And if officer asks that why you marked NO relative whereas in 2012 you mentioned the sister, then what we should say? OR the officer asks about last time reason for refusal ?

      thanks for your great help

Do not mind but please read my last post carefully.

I have written 'if her sister still actually lives in US, your wife cannot omit that info about an immediate relative."

meaning she has to write "sister" under immediate relative but do not mention her in the contact address or as the purpose of visit.

purpose of visit will be "accompanying husband on his business trip".
