  • How to move to US when I-130( for spouse of permanent US resident) is in progress?

    Hi,

My wife is a lawful US permanent resident and I live in Pakistan. We got married in Jan, 2014. Recently, she has filed I-130 for me. Our priority date notified by USCIS is May 30, 2014 through I-797. Currently she is living in Pakistan with me as she has to complete her medical studies. She visits US every year. Her medical studies will be over in early January next year(2015) and then we both want to move to US. Now since this process of immigration takes much time (approx 4 years in case of US permanent resident) and we want to move to US as early as possible after she is done with her studies in Jan 2015. What is the best possible solution for us?.

Looking forward for a positive response.

    Thanks,
    Ali

if you look at the June visa bulletin by the US state dept.( travel.state.gov),
F2A category which applies to you the current priority date is May 2012
which means for you there is a wait of 2 years plus consular processing time of a few months . Provided there is no future back log
    in this category.

The only way you can be with your spouse in US during this time is to get one of the dual intent visas
( H-1b or L1) . other visas which require a non-immigrant intent ( visitor, student, J-1 ) will not be granted to you
    because of the pending petition.
