    Hello,

    My Friend is planning to come to U.S. on a visitor visa and get married to a guy who is on H1-B visa (he is waiting for his EAD card) who is currently in U.S.

    My Questions are:

    1) Is it okay for her to come on a visitor visa to U.S and marry and then later apply for an adjustment of status i.e., H4.
    2) If it is okay, what should she tell during immigration if they ask her the reason for her visit.
    3) She has a visitor visa from Canada to U.S. Can she enter into U.S. from India via Canada and get married here or will she need to have another visitor visa(stamped in India) directly from India to U.S.?

    4) if she can come and marry here, should she need to reside in U.S. for certain amount of period before getting married?

    Use of a visitor visa with intent to marry and remain in the U.S. is interpreted in some quarters as immigration fraud, with serious consequences if intent can be proven.

    True, it is done all the time, but planning and discussing such plans on a public forum is not a good idea.

      she can legally marry on a visitor status but should not adjust to H-4 because the intent is premeditated.
      And she can marry anytime after she enters.
      She should go home and get an H-4 stamp after she is married in US.
      But be careful;saying that you have come to get married at US entry may be misinterpreted as an immigrant intent.


      A visitor visa can be used to enter US from anywhere regardless of which post issues it. So she can use the B1/B2 issued in canada
      to enter US direct from India without going to canada.
