visa for 1yr, visit for 6 months?

  • visa for 1yr, visit for 6 months?

    hello,
    my mother on a 1 yr visitor visa is close to her 6 month stay in usa and will return back to india.
    however her visa stamp in passport (at us consulate) is good till mid-march 2006.
    can she revisit me in dec to stay till 1st week march?
    will she be given i-94 to stay till mid-march only or for 6 months if asked on arrival in dec?

    if she decides to not come in dec and instead would like to come in may for another 6 months does she go to consulate for visa only after her current visa expires? (i.e. mid-march) OR can she go in feb and ask for visa: and maybe get another 1yr or more multiple entry visa?

    also what reason does one give for coming to revisit after a gap of 6 months other than to visit son and family?

    your advice will help me decide wether she has better chance to get visa for a 6 month from may 2006 onwards OR she comes in dec for a stay till end of her current expiration of 1 yr visa stamp in passport (mid-march).

    sistuation: recent widow. family: two children: both in usa me (working) and second child(student in usa)

    She should definitely NOT plan to revisit in December. Even though her visa
    allows this, she may very likely be stopped at airport and sent back to India
    for making unreasonably quick visit after a long stay of 6 months.
    Visitor visa is for visits and not for permanent stay.

    She is even allowed to enter in March on the last day of her visa validity
    and can be given a stay of 6 months but she should not for the same reason.

    Suggestion; She should apply after expiry of her current visa to visit in May.
    When she visits in May , her stated reason to visit her family will be fine.
