  • L2 to B1/B2 change of status

    I am in the US on L1B blanket visa along with my family (wife and kids who are on L2).
    At the moment, our I-94s are valid and have a few months to expire.
    My question is about a situation where our I-94s are valid but L1/L2 visa stamps have expired. In such a sitation, if for any reason such as an emergency, in case I need to leave US, then my dependants will become out of status. Is there any way my dependants can remain in the US for 3-4 months even after I leave. The intent of their stay would be to complete kids school and/or to visit other close relatives in the US. Is L2 to B1//B2 change of status possible for my dependants in such a case? They do not have approved B1/B2 visa as fo now. But is it possible for them to change to B1/B2 from L2 while remaining in the US before I leave?

    yes it is possible but change of status process takes about 3 months.
    If you can wait that long a period to see the response ( approval or denial), and so that the process is completed while they hold their L2 status,
    they should file an I-539 now.
    If you can afford a good attorney, file through one .
