I am a US citizen and my wife is a Germen citizen . She is currently in the US with me on a B1/B2 visitor visa. She came here in March 2014 and we got married at court house. I went to Germany in June and we got married(religious ceremony) in June over there and then she came back with me. We were undecided as where we will be living. We decided we will give US a try so we applied in July for i-130 which is still pending status initial review. Her i-94 states 12/21/14 and her return flight back to Germany is 12/7/2014. Can she travel to Germany and return without any issues? I've read that it's better for the person to stay put in the states until the processes is over but is it possible to travel back to Germany and return back to US? Any input will help. I great appreciate someone shine some light on my situation. Thank you in advance.

Have you also filed an I-485 with the I-130? I-485 is the request to change status from visitor to green card if the I-130 is approved.
If that is the case , leaving US will automatically abandon her I-485. She will need to apply for an AP , advance parole and then she can travel while I-130 + I-485 are pending. -
No. i haven't filed her i485 yet. I consulted with a immigration attorney today and got the information i needed. Thank you for replying.Comment
