  • expired i-94 (Medi-Cal issue)

    Hello everyone!
I'm asking quite popular question about consequences of expired i-94, I haven't found exactly my situation @ this forum.
We entered to US by B2 tourist visa and were planning got asylum.
So, I came here with my wife and son December 2013, POE put 6 months on i-94 stamp.
We used MediCal for pregnancy and delivery.
April 2014 our second baby was born.

But there are unexpected changes in our life and we haven't applied for asylum yet (there is no A number or something) and we have to leave US.

What consequences we would have in this case with expired i-94? (we expired less that 180 days). I heard about 1 year ban, but we used MediCal which makes this situation much worse.

    Thank you in advance.

Expired less than 180 days, there is no ban. But you can't re enter on this visa again. You will have to apply for a new visitor visa.
And they are not likely to give a visitor visa to you because you overstayed.

You can apply for a different kind of visa like a work visa ( H-1 or L-1) and there won't be any problems with that.
Using Medi-cal is not relevant here.
