Last day to fly on visitors visa????

My visitors visa is till 3rd Jan 2006.What is the latest date I,m allowed legally to fly back.There are seats available for 3rd Jan from Newark Airport in Air India,and I have a open return journey ticket with them.But one of their officials told me that I cannot fly on 3rd Jan because one needs to fly 48 hours prior to expiry of his/her visitor visa.Is thre really any rule like this or he just bluffed????????

I would think that as long as the date that you fly out which will also be the date that you surrender your I-94 is not later than the date stamped in your I-94 you should be ok.

Also you can leave after that date without any problems, no one is going to stop you. The only problem you will have is that the next time you will be asked to explain the reason for overstaying your visa and sometimes in extreme cases they might reject your visa when you go to apply for it the next time.

There is no rule of 48 hours.

You can leave any time before or on the date on your I-94.

Hi!
If you have a ticket on the day your visa is expirying, just make sure that you leave before 3rd becoz 3rd mid night is 4th Jan. I would suggest just prepone the ticket by 2 days. Always good to leave a couple days earlier. Technical you can leave anytime before Jan 3rd 11:59pm BUT you are taking chances. As in any delay of airline due technical, weather etc etc you are then considered to have over stayed.
