  • Mother of Minor US Citizen applying for tourist visa

    Hello,

Any help would be appreciated. This is the situation:

I am a single mother with a US minor child. I applied for a tourist visa for myself to go visit with my child the child's father in the States. He is sponsoring the visa. My visa request was denied. The father of the child is married to someone else in the States. I am not married. I don't have a job. He supports me financially. I have property. My family ties are my mother and sisters who are all married.
I am applying for another tourist visa soon. What are the chances I will be granted a visa? Does having a US child make it more difficult or easier to get a visa? The child was not with me when I applied the first time. Will bringing the child along guarantee a visa?

    Thank you so much

Having a US born child and the purpose to visit child's dad both make it very likely that you will not return.
so it will be difficult for you to get visitor visa.

Were you ever married to the child's dad? Your child is US born so when were you in US before when
    the child was born?

Hello and thank you for your response.
I was never married to the father of the child. I went to visit him years ago and during the visit got pregnant. When I returned to my country, Serbia, I realized I was pregnant. I had the baby in Serbia. I was hoping we would get married but he said no. The father acknowledged the child and the child was registered at the Embassy in Belgrade. The child has a USA passport that says Born in Serbia. I have not been back to the US since then. The father does come to visit in Serbia but I want the child to go to USA to visit him there.

The father is married to someone else in the states. Does that affect anything?
Would the consular be persuaded to give me a visa if I bring the child with me? If the child asks them would they be more inclined to issue it? The child is 10 years old.

Thank you so much for your assistance. It is so much appreciated.

Like I said before, getting a visitor visa will be very hard for you. Having a US citizen child is a negative for your visitor visa.
They do not care about your concern to unite the child with his dad but their main concern is whether you will return home to Serbia after the visit.

I think you should consider other visa options like a work visa.
From your English it seems you spent several years in US or an English speaking country.
What is your education? Are you working in Serbia?

          Hi,

I do not work. I have not worked in the last 11 years. The father of the child is my financial supporter. I have a high school degree but I learned English by myself and I keep up with it (especially for the sake of the child).

When I first applied for the tourist visa, I showed the counselor just the child's passport, thinking that would be enough to issue me one. The counselor declined, asked where the child was (I said at home), than he said I could reapply in one year and bring the child with me. That's why I was wondering if bringing the child along would make a difference in their decision. If the child says that she wants to go see her father, how could they say no?

I plan to show them next time information on my property (which the father paid for), my bank account, and a letter from the father to the Embassy inviting us. Is that a good idea?

Thank you for your insight, it is very valuable.

Depends on your passport. Did the CO ask about the circumstances of birth and your US status at the time of the birth of the child? How is the child a US citizen?

Invitation letter could be considered as fraud among other papers.
