EAD work permit (L2)

Hello,

I will be applying for EAD on L2. L1 Visa holder is in US. EAD process SLA is 90 days. I will have only a month's time to stay in US and apply for EAD.

1. Is it mandatory to have I 94?
2. Can I apply for EAD before travelling to USA. For example, if I am travelling to US in march 1st week. can I apply for EAD a month before. L1 Visa holder is already in US.
3. If I have travel to US and then apply for EAD, is it mandatory for me to stay in US untill EAD process is completed? If I have to come back from US before EAD process is complete, will my EAD process can still continue or the case will be closed?

Hi preeti

1) while applying online for ead i94 not required but when you mail them all the required documents your i94 and your spouses very important.

2) you can apply for your ead but within a month they would call you for your biometrics.

3) you have to be here till your ead process is complete coz first they would ask all your documents, then biometrics, then any additional evidence n then a decision would be taken , then an interview then your card finally.

Thanks! Can you please tell me if is it legal to work from US - at home (if company allows him to continue on the same project) without work permit. He will not be getting any US salary, only the benefit of being in US.
