  • I screwed up my family's US visa application

    I moved to US under L1A visa since 2011 and got my green card last Nov.

    My dad and my brother's applications were both denied because I accidentlly gave them a wrong file of mine.

    Before getting official green card, I had a EAD/Adavance Parole. So instead of green card, I accidently scanned Advance Parole. I didn't give them anything else from my side other than advance parole, invitation letter and my past three year tax file.

    The officer got my Adavance parole and told them this is not a green card. Then he used the card to locate my information but came back told them " I only had tourist visa. Never had a work visa ( I got my L1A from the same consulate!!!) or green card. " he even questioned how come I claim I have green card within such short period time with holding a travel visa and whether I married an American." My family tried to explain and provide my tax file. The officer would not look. Then the application got denied.

    I got it. I screwed up. But it is shocking that how come their system won't show up my work visa when I got my work visa application from the same place. How come they won't find my green card status?

    My lawyer recommend me to appeal with senator. Shall I go that routine?

    If the visa denial under section 214(b) of the INA then you should make a note that a refusal, or ineligibility, under section 214(b) is for that specific application, so once a case is closed, the consular section cannot take any further action. "THERE IS NO APPEAL PROCESS". If you feel there is additional information that should be considered related to the visa decision, or there are significant changes in your circumstances since your last application, you may reapply for a visa. To reapply, you must complete a new application form, pay the application fee, and schedule an appointment for a new interview.
