  • Parents visiting while Green Card is processing?

    I am planning to have my parents visit me this summer (May/June). My green card expired on Jan 29 of this year, and I have the I-797 form that has extended my status for one more year. My conditional status removal application was sent way back in November 2014, and I had thought that I would at least see some sort of progress on the green card application by now, so that, come March or April, I will have my green card in hand (so that I could send my parents a copy of the new green card to take it to their interview). It is February now, and I still cannot see any update on my application status via USCIS. I do not know how long does it take for the spousal green card to process (my processing office is out of Laguana Niguel, CA)

    I am in a dilemma now

    a) Should I postpone my parents' visa interview (scheduled for May 1)? Postponing the visa interview is also another problem for me because the visa fee receipt is valid only for one year from the date of activation, and I had made the visa payment last year on May 14 when I had visited them.

    OR

    b)Should I take the risk and send them for the interview? If they do go to the interview with the green card xerox and the notification from USCIS about the pending status, is it going to be a hurdle to get their visa? Won't the embassy think I am trying to sneak my parents here illegally?

    So, basically, I am playing in a tight window here. Any advice or help would be greatly appreciated.

    Please note that Non-immigrant B1/B2 Visa is for a temporary visit for the purposes of pleasure, business or medical treatment.
    This visa is issued solely on the basis of applicant's own circumstances, specific intention, travel plans and compelling social or economical ties that will ensure applicant's departure after a temporary visit.

    In order to qualify the B1/B2 visa, you do not require any sponsor from the United States. Please bear in mind.

    Before applying to NIV, you must make sure that you fulfill the following criteria;

    If you apply for a B-1/B-2 visa, you must demonstrate to a consular officer that you qualify for a U.S. visa in accordance with the U.S. Immigration and Nationality Act (INA). Section 214(b) of the INA presumes that every B-1/B-2 applicant is an intending immigrant. You must overcome this legal presumption by showing:
    • That the purpose of your trip to the United States is for a temporary visit, such as business, pleasure, or medical treatment
    • That you plan to remain in the United States for a specific, limited period of time
    • Evidence of funds to cover your expenses while in the United States
    • That you have a residence outside the United States, as well as other binding social or economic ties, that will ensure your return abroad at the end of your visit

    If think that your parents can qualify the requirement, send them for the interview. Otherwise, do not take a risk.
