  • Who are immediate relatives

    I am in the process of applying for visa. I have my sister and bro in law in USA. On h1b visa. In the columns of immediate relatives I have written my sisters name. Does my bro in law also to be mentioned in immediate relatives or in the column other relatives.

    Can somebody please respond. Whether brother in law is considered immediate relative

      For immigration purposes, an "in-law" is not considered an "immediate relative." Having said that, however, I would add that spouses and children of immediate relatives are eligible for derivative family visas for "quota-based" visa procedures.

        Thank you Rayb for your response. I think I will be a little clear here. I am applying for a B2 visa for myself. In the visa application form there is a column whether you have any immediate relatives. I will be mentioning my sisters name here. However should I mention my brother in laws name here or in the column "other relatives". both my sis and her husband are on H1b visas. I will be self supporting and I have a travel history to Europe. So I have no issues on that count.your early reply will be great. Thanks in advance.

            You may just mention your sister and others are not that important.

            Even if you add your brother in law's name in other relatives column, there's absolutely no problem.

              There is no reason to report "in-law" names.
