  • Sister applying for visitor visa and brother-in-law already has valid B1/B2

    Hi All

I am looking to sponsor my sister and her two kids for a visitor visa to the US. My brother-in-law already has a valid visitor visa and will be traveling with her. My question is should I mention my brother-in-law's name in the following documents since they will be traveling together:
    a. I-134
    b. Letter of invitation addressed to consulate and them?

    Thank you
    Sivakumar

You will need to submit a DS 160 Nonimmigrant Visa Application on their behalf in addition to your I-134 Affidavit of Support (used to supplement the application). On the DS 160 (completed electronically) you'll need to provide information on your brother-in-law. You'll need to attach a letter of invitation addressed to your relatives and may send a cover letter addressed to the consular officer detailing the elements of your application and the purpose of the application.
*Always be truthful and as forthcoming with information as possible during visa/admission/adjudication interviews. If it is discovered that you have misrepresented yourself during processing the penalties can be severe.*

Thank you imm_o22. But do I need to include brother-in-law on my I-134 since he already has a visa and is not appearing for the interview?

You don't have to. Having said that, the I-134 is seldom looked at in B2 decisions. What your sister should be prepared to answer is (a) what you do here in America (details of your job/company/business), (b) where you live, (c) how you first went to America and (d) your income. In my opinion, more relevant than the I-134 would be a statement from your bank and pay slips of past 3 months. If the answer to (a) is credible to the visa officer, no documents will be looked at regarding your income.
