  • Help on B2 Refusal visa

    Hi,

    I need help and advice.

My U.S B2 visa application was rejected today this is how the interview went.

After exchanges of greetings. She ask me why I want to visit USA. I said Tourism, Where in USA I answer Miami Florida
She asked have I applied for Canada Visa. I said yes and ask did I submit a fraudulent Bank statements. I said no. She asked if I am married I said yes. She ask if my wife is a citizen of my country of residency. I said no I married a woman from my country. She ask where is she staying I answer same as my home address. She asked if we got kids. I answer her that we expecting a baby in September. She saw my expired passport and saw my travel history to Germany, Poland and United Kingdom. She asked how long have I lived in my present country of residency I answer 7 years. She asked about my job I answer her that I am the Director of my company. She never asked to see my documents. But the visa was refused. She said sorry I am not eligible for visa today I should apply some other time.

To my understanding. I think my U.S visa was refused based on Canada who refused my visa application twice when I was single I applied. The first reason for the refusal was that my immigration status in my country of residents and not sure I will return back. The visa was refused 2nd time after waiting for almost 120 days that they are not sure I will return back and also the purpose of my trip and my contact in Canada which was a paid tour company that never refund my deposit I made to them last year in 2014. I believe the Canada VO comment on my application that I submitted **** **** **** * bank statement which was not. I earn monthly payment from my business for the past 3 years and I do have the statements. I have never in my life used any **** **** **** * documents to apply for a visa when I do have a reliable source and a credit card from bank and in the refusal letter it never states that I submitted a fraudulent bank statements.

My question is should I reapply at USA or Canada and write a latter due to the question ask at the USA embassy to kindly ask the VO at Canada embassy to personally request my bank to send my bank statements to them to confirm that I have not submitted any **** **** **** * bank statements and clear this comment off their system? Even if they will not be granting me the Canada visa but I just want the mistake from their side to be rescind not to affect my travel history when apply for visa in another country.

I do have a permanent resident in South Africa.
I do have a wife in South Africa
I do have a business that generates income for me.

The last time I went on vacation was 2012 to Europe and never travel out of the country ever since, I am tired of Europe. Should I try to apply for Australia? Hope I won't face same issues? if they share same applicant database with the USA, Canada Please advise on what to do I do really need advice. Even if am not going to get the Canada visa how do I write them to correct the mistake made by them. I never over stayed any of my previous travel.

    Regards
    Dele

Why did the issue of your Canada visa denial arise at all at a US visa interview?

Was your wife applying with you for the B2? If not, this may have been a red flag to the visa officer.

There is an agreement between the Government of Canada and the Government of the United States of America for the Sharing of Visa and Immigration Information.

I applied for the B2 alone. Moreover she is pregnant and still waiting for her own Permanent resident to be issued to her. So she can't travel out of the country at the moment. I believe luck was not on my side that faithful day... because if the VO office looked at my documents she will be convinced to my own understanding.

Do i reapply to Canada now or just try the USA again?

What exactly is your intention and purpose?

Why your trip is really important to you at this point of time?

Why are you in dilemma of applying for Canada or USA?

Remember, you should convince the visa officer that you have non immigrant intent, strong ties to home country and a very genuine reason/purpose for your visit, in order to qualify for the B visa.

Try to find out your negative points, work them out and try again after changing the present circumstances.

              Good luck.

This is my opinion, not a legal advice.
