  • Entering with B-2 right after J-1

    Hello everyone,

I am currently on my J-1 visa which will expire on 31 May 2015. Considering 30-day grace period, I can stay until 30 June 2015.
I also have tourist visa which is still valid and I'm planning to use it after my J-1 program ends.

I'm trying to maximize my stay in the USA and I have two options:
    • Immediately leave USA and come back as a tourist after 7-10 days.
    • Leave after grace period ends-by the end of June- and come back as a tourist after 7-10 days.

I wonder if there is a risk of denial or less than 6-month admission in case I use my grace period to the fullest and then try to come back as a tourist after such a short time. Do you think using the grace period and coming back after a week can be considered as an exception to following rule:

"(2) Minimum six month admissions. Any B–2 visitor who is found otherwise admissible and is issued a Form I–94, will be admitted for a minimum period of six months, regardless of whether less time is requested, provided, that any required passport is valid as specified in section 212(a)(26) of the Act. Exceptions to the minimum six month admission may be made only in individual cases upon the specific approval of the district director for good cause."
    Thank you in advance.
