Help -Brother B2 Visa was denied .. Reapplying need suggestion

  • Help -Brother B2 Visa was denied .. Reapplying need suggestion

    My mom and brother applied visa together Mom Visa approved but they Rejected brother visa . My brother is married and have two kids but was applying alone with mom as my mom cannot travel alone . Plus my sister in law and kids didn't have passport

    During interview they didnt ask anything to my mom but asked below question to my brother.
    Interview date : 19 march 2015.
    VO : How long you are going
    Brother : 3 weeks
    VO : What do you do
    Brother : GOvernment job Assistant engineer in Power development department
    VO : Why you going alone
    Brother : Kids as school they cannot accompany me
    VO : What your salary
    Brother : Rs ABC
    VO went to other window talked to some guy came back and said we cannot give you visa this time bt giving to your mom.
    Brother : My mom cannot go alone
    VO : Should i reject her as well.

    I think we did one mistake in DS-160 we mentioned he is paying for his trip instead of me sponsoring him or may be they denied as he is applying with his family not sure .
    we are reapplying 15th April as i have function at my place in USA end of may and i want my mom and brother to attend .

    So he is reapplying and my sister in law and his elder son also got passport . As of now he only applying again so not sure whether he should apply again alone or with his wife and elder kid as younger kid still not have passport.

    So should he apply alone or with family and this time in DS160 will mention I am sponsoring his trip. Last time i gave him all sponsorship documents bt didnot mentioned in DS-160 and VO didnt ask any question to him.

    Unless you figure out the reason for denial, it is a waste of time & money to apply again within such a short time. From your description, there are a couple of possible reasons. One, his salary is low (note: I am guessing here) and is not consistent with his claim of self-sponsorship. Two, when asked why he is traveling alone he should have expressly stated that his reason for travel was to accompany your mother.

      Thanks for your reply but how to figure out reason VO did not give any reason and he answered her all question. I also think his salary was issue plus self sponsorship. Even though I provided him all the sponsorship documents from my side but in DS160 he mentioned by mistake self paying for trip. So this time we will mention in DS-160 I am sponsoring him .

      Rest he has good government job but government salary is not that high as private.

      I already booked appointment for me so my concern is should he apply alone this time or with family.

        He wasn't refused the visa because he did not apply with the rest of the family. If anything, he has reason to come back if his family is back home in India.

        When you fill the DS-160 this time, there is a section which asks "Have you been denied a visa?" In that section, there is space to explain. Clearly explain there that the purpose of the visit is to serve as a companion to your mother who cannot travel alone.

        At the interview, he should speak up and explain the situation to the consular officer. Providing brief answers won't help in this case. He has to be persuasive (without being argumentative or long winded) and this means you have to prepare carefully and practice for the interview.

        Also: if you are going to fund his visit, he should be able to answer questions about you, your job, place of residence, visa status and so on.
