  • B2 Visa Queries

    Hi Everyone,
This is ****ha, my family(mom and 2 bros,my father expired) had a B2 visa interview today. I have my graduation ceremony due on may 30th 2015.The reason for putting visa interview at this time is graduation.Unfortunately visa was approved for only my mom and rejected for my brothers under reason 214(b).

    my questions here are:
1)Can they reapply for visa again? if yes what is the procedure i need to follow?
2)Are there any chances of getting them visa if I schedule them again appointment before may 30th?(my elder brother takes care of family businesses and younger brother is persuing b.tech 3rd year).
3)I am not sure the reason for visa rejection , the reason for rejection given by interviewer is that she is not satisfied with my brothers answers(my younger bro told that he is persuing his studies and elder brother bold that he is taking care of business).
4)is it a good decision to reapply them visa again before may 30th?

Any help or info on these is very much appreciated!

    Thanks in advance.

It would be helpful if you gave the interview details in a Q and A form.

      HI pb2au,
I didn't get you. Are you asking about my mom visa experience or my queries?

      Thanks

          Hi everyone,

Here is the visa experience of my family.Interview was on April 15, 2015 @ 8.30 A.M

          Family:Hi, Good morning(interview was at 8.30 Am)

          Visa interviewer to Mom:

VO: Why you want to visit USA?
Mom: To attend my daughters graduation ceremony and also to visit few tourist places in USA.

          VO: are you married?
          mom: I am widowed

          VO: what is your profession?
Mom: I am a home maker

VO: does your daughter work on CPT?
          Mom: yes

That is it for mom. Interviewer said that "your visa is approved you can collect your passport when its ready"

          Visa interviewer to Brothers:

VO: Why you want to visit USA?
Younger Brother: To attend my sisters graduation ceremony and also to visit few tourist places in USA.
Elder Brother: To attend my sisters graduation ceremony and also to visit few tourist places in USA.

          VO: are you married?

Younger Brother: no , i am unmarried

          VO: what is your profession?
Elder Brother: I am taking care of my family businesses
Younger Brother: I am Persuing my B.Tech 3rd year.

VO: does your Sister work on CPT?
          Elder Brother: yes
          Younger Brother: yes

That is it for brothers, interviewer said that" I can approve your visa as your answers were not satisfying me"

I have selected the language as Telugu as my mom doesn't know English. All the above conversation was in Telugu I have translated to English so that everyone can understand the experience.

That is it, the interview was done within 15 minutes, no documents were asked.

          Thanks,
          ****ha

When they fill the DS-160 for the next attempt there will be a question, "Have you been refused a visa before?" to which they will have to answer Yes. After that a field opens up to "Explain." Here they should say they were denied under section 214(b) and then add a paragraph or two to the effect that they would like to accompany your mother who has already received the visa for your sisters' graduation as well as to enjoy a brief vacation as the whole family will be together. Then add the nature of the brothers' business and (assuming it is true) add that it is a healthy, stable business generating good income. There is no word limit on how much you can write in this section, but you want to convey the essential information without making it too long.

When they go in for the visa interview again, they may be asked "What has changed since you came here?" This time they should not stick to giving terse answers. Instead they should engage the consular officer and explain that this is an occasion for the whole family to be together, that mother was granted the visa, that you have a good business going etc. They should be persuasive without sounding argumentative. This means they have to prepare well by creating a pool of all questions that could be asked and writing down the responses to them, then doing mock drills. This helps in conveying all the points you have to the consular officer in the most efficient manner possible.

Note: I don't know what was filled out in the DS-160 the first time. All the information there should be consistent with what is said in the interview. What you enter into the DS-160 is extremely important.

From your account below what seems to be the main concern is the fact that they are unmarried, you are on CPT, and the whole family will be in America with an incentive to not return. Therefore your brother has to emphasize his business and make the case that it is important and lucrative enough to make his return worthwhile after a brief stay in the US.

              Hi pb2au,

Thanks much for your response, I really appreciate it.

yes that is correct my elder bro is taking care of business.I have specified the same in Previous Ds-160.

Many questions are going in my mind and not able to decide whether to apply them for visa again or not.Specifying few of them below.

              1. Are there any chances for them to get visa ? as they don't have strong tie-ups?
              2. We have lower monthly incomes but have properties and land of good value, will this help them as a tie-up?
3.is it a good idea to send both of my brothers for second attempt? or to send only my elder brother.
4.as my younger brother may try for student visa next year once he is done with bachelors. These rejections will have any impact on his student visa? I heard that if visa gets rejected multiple times within short duration, it will be a problem for them to get student/Any other visa in future if they want to apply for any other visas. is that true?

is it a good idea to send them for visa interview again or not?

              I am totally confused.

              please help me here.

              Thanks in advance

More Info added to previous post on my present statuses.

I am not on CPT now. I have finished my masters in Jan 2015, i got my GC EAD in Dec so once my classes are done I have activated my GC EAD and am currently on GC EAD not on F1.

As i got GC EAD , I haven't applied for OPT as both OPT EAD and GC EAD are pretty much same.

                Thanks
