  • Visitorr Visa for Parents rejected.

    Hi All,

    My parents had a visa appointment in Hyd consulate on May 13th and their visa got rejected . The VO officer issued 214b refusal notice.
    VO officer did not checked any documents but visa got rejected. My question here is in how many days i can re apply visa for them ?
    And what strong ties we need to show for my parents that they will come back to India for sure .My parents has business in India and properties .
    Other than that what do i need to show ? My brother also stays here in US. Is that a concern ?
    Please help me .

      Father : Answered accordingly
      VO: When did your Son came to USA?
      Father : answered correctly
      VO: When did your daugther came to USA ?
      Father : My dad confused here and told about my recent visit 2014, but i had been to USA in 2010 on L1 Visa.

      VO: Refused Visa saying that information did not matched and issued 214g.

      We are thinking that because of the last answer their visa got rejected, not sure of other questions because other questions are simple ones and there is nothing to hide.

      Please guide us when can i reapply Visa for them?

      We are planning to have family vacation in July and i want them to be here in July.

      Appreciate your reply.

        Could anyone please reply to me ? In how many days i can reapply ? I want to apply Visa for them again by June End. Please suggest me.
        And also Do i need to apply for them both or Can i apply for my mom first and then my dad again ?

          Presumption of immigrant intent

          The Immigration and Naturalization Act (INA) states under Section 214(b) that:

          Every alien shall be presumed to be an immigrant until he establishes to the satisfaction of the consular officer, at the time of application for admission, that he is entitled to a nonimmigrant status.

          The easy answer, of course, is for them to apply for immigrant visas.

          It used to be good enough that passive investments (non-participating businesses, land) was enough to show ties that compelled aliens to return to their homeland. The experience of consular officials, over the years, has taught them that those are not strong enough ties. It would help if your parents have lucrative jobs that they were dependent on, government posts that they were compelled to return to, dependents in India who are relying on them, etc.

          Let us be honest, many people in your parents situation end up overstaying their visas, to live with their children and care for their grandkids. They need enough evidence to rebut this presumption.

            They can apply at anytime. A prior finding of 214(b) is not prejudicial for future applications. But, if the facts and the evidence are the same, they can expect the same outcome.
