  • H1B extension after (L1 + H1) 6 yrs

    Hi There!

    I have spent 4.5 yrs. on L1 and got fresh H1 in 2014 valid for only 1.5 yrs. (to compete with 6 yrs. limit). Please consider this case for both below questions.

    Question1: If I leave USA and spend 1 year abroad, can employer apply for H1 extension or Shall employer go through filing fresh H1 application(LCA, Lottery etc.).

    Question2: Does the six year limitation make any Visa in Hand invalid(Even though never fully utilized)?

    Please let me know if I am not clear.

      Q1 :If you leave US & take one year break, your current H1b becomes invalid. Employer needs to file fresh H1b, your H1b clock starts again if approved (6 years clock).

      Q2 : 6 years limitations makes H1b invalid, USCIS needs strong reason to extend current H1b beyond 6 years like waiting for green card through employment etc. Also, it seems you're quite late on applying for Green Card through employment now, Better to consult with good Immigration Lawyer.
