My girlfriend is coming to the United States on June 8th from China. Previously she entered into the United States for 1.5 months (Dec 25 - Feb 15); entering from Chicago and leaving from San Francisco. During this time we took a cross country road trip from Chicago to Arizona, stopping at Mount Rushmore, Denver, Wyoming, New Mexico, the Grand Canyon, Antelope Canyon, etc. We did this with my sister, our trip was well-documented with photos, and it was very touristy. She did not work, want to work, or try and work during this time.
Now, she's planning on returning while we get everything ready for a K-visa. Initially she'd received 6-months on her original I-94, which expire June 22. Now, I've booked plane tickets from June 8th to November 30th, six months. After a six month stay, I plan on going to China with her and meeting her family. During these six months, she plans to spend a lot of time with my family in Denver, Wyoming, and Arizona without me doing tourist-y things like skiing, seeing dessert stuff, hiking, and other sightseeing - once again, she does not plan to work, want to work, etc. We have explicitly planned to do a K-visa to avoid committing any type of visa fraud and absolutely do not intend for her to stay as an immigrant on a non-immigrant visa.
After reading this forum, I'm a little frightened by her telling a CBP agent she plans on staying for six months now. Let's say the dates are flexible - which they absolutely are. Could she tell the CBP that she plans to return in September - not actually an untrue statement - if she has a ticket for November?
