  • Visitor Visa - But H1 Expiring

    Hi

I am currently on H4 and my husband (who is on H1 b) is sponsoring for my parents and the interview appointment is scheduled on May 30, 2006. But our Visas are valid till oct 20 2006. We would be extending that though, My Query is

    1. How long could my parents get visa for? Will it be till Oct 20 2006 only?
    2. How long could the 1-94 stamping be for?
    3. Can we apply for extension now and send the extension receipt to them before interview? Will that help them to get a stay of 6 months?

Please guide us. Did anybody else have the same issue.

    Rgds

If your parents are issued a visa, the length of stay is determined by the POE based on the purpose of visit and circumstances regardless of your extension.
Normal stay allowed is between 3 - 6 months.

        Hi!

You don't have to worry so much. Your parents I94 is irrespective of your visa expiry. It just depends on the officer at the POE.
