Please help!
My GF (soon to be wife I hope) came to the US in 2013 from Denmark as an au pair on a J-1 Visa. We got very close and she decided to apply for a B-2 visa to stay longer and travel, after her J-1 program would have ended in March of 2015. Her J-1 program has expired, but she is able to stay due to her pending B-2 visa. It has been months (end of July now) and we have not heard anything about her B2 visa, only that they are still processing it and will have an answer soon. We have also decided to get married as we are very much in love, but this really complicates things.
Can we still get married if she has a pending B-2 visa, but an expired J-1? If she cancels the B-2 visa or if it's denied, would she have to leave immediately? Would canceling the B-2 Visa be unecessary? Would she have to leave the country regardless if we get married? Also, she does not have a 2 year residency requirment if that makes a difference.
Any other information regarding this issue would be greatly appreciated!!! thanks!!!!
