  • Parents of US Citizens

Hi folks. I´m the father of two under age US Citizens (ages 11 and 16) and curently we (me, my wife and our daughters) live in Brazil... My oldest one is a Special Kid. She was born with two deadly viruses. After 5 years we moved to Brazil. She´s having a hard time here because there is no professional help for her situation... We are on the process of moving back to the states. We lived there for about 8 years (from 1996 till 2004) iligally but my wife was being sponsored by the company she worked at...but some how it didn´t work out. Now Emilly needs assistance more than ever. I read about the I R 5 Visa and seems she has to be 21 years of age or above. Is there any other way for me and mom be legal instead of looking behind our backs?
For those 8 years we paid our taxes and owned a home back in Connecticut... We sold it before moving here...
If anyone could give some sort of advise we will be xtremelly thankfull!

You have two choices, which are probably complicated by your having become a visa overstay while in the U.S.

Apply for visitor visas so that you can accompany the children back to the States. If either or both of you are denied visitor visa because of your overstay history, then someone in the States must try to enlist assistance of a Congressional office on behalf of the chilldren to try to obtain humanitarian-based paroles to enter the U.S. to take care of the children.
