  • Parents Got Their Visa Cancelled Still Eligible for Resident Green Card?

Hi guys - Just a very specific problem I am facing. My parents had me in the US, I believe they used some kind of government wealth fare to cover my birth costs. In like 2007, we went to renew my US passport, and as we were on the process, they got their US visas cancelled due to them not paying for my birth costs back in the 1990's. So my question is, I am now eligible to petition them for residency, would their visa's cancellation pose a problem to this?

FYI - their nationality is Venezuelan.

Very much appreciated for any responses!

There is no way of telling whether petitions for parents would be impeded because of that 1990 government cost. Submit a petition for one parent and take it as far as it can go to find out what barriers, financial or legal, would have to be overcome.

I highly doubt this is correct. Not saying you're lying - just saying you may not have your facts straight. What probably happened is that your mom checked in at the hospital through the "emergency room" trick - she had you, she was presented with a bill - and she provided false information, or true - but she skipped on the bill - ie, your parents never paid the bill. This is an issue of *civil law*, not *criminal law* - so no criminal charges brought against your parents, hence no basis to deny them a visa to the US. So I don't think that's the situation here.

What is happening here (most probably) is that their visas were cancelled because they were Burroughs visas, aka "indefinite validity" visas. Check their passports. The other reason would be that when they were renewing your passport, the consular officer was suspicious they were renewing your passport and they would then travel to the USA and stay there as illegal immigrants - another reason to cancel their visas.

For your other question, about getting them a permanent resident card - you *might* be OK, or not. "Running back to your home country with unpaid debts", while (again) not a matter of criminal law, is proof of "moral turpitude". Moral turpitude is ""conduct that is considered contrary to community standards of justice, honesty or good morals." - and their previous behavior COULD BE interpreted as such.

So, in short . . . apply for their residency.
