I am a Canadian citizen and plan to explore an investment opportunity in the US. I am already in the US for about a month and plan to apply for an appropriate visa later. The exploration/research phase for the business will take up to a year. I understand that as a treaty investor, I should be applying for a E-1 visa. However, I want the B-1 to cover the the pre-investment research period, which will go beyond the six-month period I am allowed to stay in the US. I have received conflicting information regarding the application for a B1 visa/change of status. So, my questions are:
1. Should I be able to apply for a B-1 visa while I am traveling in the US?
2. Can I change my status from B-1 to a E-1 when I am ready and committed to make the investment?
3. Do I have to apply from Canada for either 1 or 2 or can both be done through change of status while in the US?
I would much appreciate any advice.
