Can a person banned from entering get a subpoena to court? 2 part question......

Hi. I know a person who overstayed their visa over six months. When they exited the country would they have been informed if they were now banned? And, If they were banned from entering would a subpoena trump the ban? To be clear, would INS and customs have to allow them to enter and answer a subpoena even if they had a ban?

Any knowledgeable answer is appreciated, especially from an attorney.
