    Hi,

    I'm 25 year old male from England.

    Just wondering if anyone could give me any help, basically I was in America from November 2014-January 2015 travelling on the 90 day ESTA VISA, I then left the states and went to Canada where I was attempting to working but I wasn't able to get a visa so instead of going home I decided to go back to America and restart my 90 days there, however I was denied entry and now not allowed to use the ESTA any more as apparently going to Canada and then back to America does not reset the 90 days allocated.

    I went back to England and after coming into some money decided I wanted to go travelling around America again three months later, as I hadn't got to places that I wanted to go last time, so I spent three months in America and came home. I had to go through secondary immigration when entering America due to the my previous visit and it was a very close call but they did let me in. I had previously checked immihelp and apparently it helps if you have ties to your home so I brought as much information as I could that would put the immigration officers at ease.

    However, next year I am planning on getting a two year visa to go work in Canada, but before I go there I would like to visit friends that I have in LA for two months, obviously I won't have a flight home booked or a job back in England but I should hopefully have this all sorted out for Canada (including an onward trip to Canada...) do you think maybe America immigration would see this as OK? I will have ties to Canada, an apartment and job lined up but no ties to my actual home in England...

    Because you will be able to show the job offer/acceptance letter, apartment lease, etc. in Canada, it should not be a problem. Of course it is always up to the consulate officer on any given day, but clearly your intent is not to immigrate to the U.S..

    Also, your coming from the U.K. so your not looked at as a high-risk for immigration anyways as you might be if you were coming in from another country. The fact that you have traveled here before and have gone back several times should only improve your chances of approval. The only reason they probably had any pause prior was due to the fact that you had just been here for a fair amount of time and were already coming back in for 3 months.
